These Terms and Conditions (AGB) apply to the use of the software Stegback by customers (hereinafter referred to as "Users"). By registering or using the software, the User accepts these Terms and Conditions in their current version.
Stegback offers a software solution for [brief description of core functionality, e.g., "data management and backup"]. The software is accessed via a cloud platform, and the User gains access to the provided features according to the chosen pricing plan.
The contract between Stegback and the User is concluded as soon as the User registers and accepts the respective service agreement. The contract is open-ended but may be terminated according to the provisions outlined in §9.
Stegback grants the User a simple, non-transferable, and non-exclusive right to use the software for the duration of the contractual relationship. The User is not permitted to modify, decompile, or copy the software, except where permitted by law. Any use of the software beyond the agreed purpose, particularly for commercial resale, is prohibited.
The use of the software is subject to fees, unless expressly stated that a free version is available. Prices depend on the chosen plan and are displayed on Stegback’s website. All prices are subject to applicable VAT. Payments are due monthly/annually in advance. Payments can be made using the payment methods listed on the website.
The User agrees to keep their login credentials confidential and prevent unauthorized third-party access to the software. The User is responsible for all content uploaded or processed via their account. This includes ensuring that no unlawful or copyrighted content is used without permission. The User agrees not to misuse the software, particularly for spreading malware or engaging in illegal activities.
Stegback aims to provide 99.9% availability of the software on an annual average. Short-term maintenance or updates may cause temporary limitations. Stegback is only liable for damages caused by willful misconduct or gross negligence. Liability for minor negligence is limited to typical, foreseeable damages. Stegback is only liable for data loss if such loss would have occurred even with proper data backup by the User.
Stegback collects, processes, and uses personal data of the User only to the extent necessary to perform the contract. Details about data protection can be found in the separate Privacy Policy. The User has the right to access, correct, or delete stored personal data, unless legal retention requirements apply.
Either party may terminate the contract at any time with a notice period of [30 days] to the end of the month. The right to extraordinary termination for good cause remains unaffected. Good cause exists, in particular, if the User violates significant obligations under these Terms.
Stegback reserves the right to amend these Terms as necessary due to technical or legal changes. The User will be informed of any changes to the Terms in advance. If the User does not object to the changes within [4 weeks], the amended Terms are considered accepted.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from this contractual relationship is the location of Stegback’s headquarters.
